Regent Of Jember Faida, Impeached And Then Suspended For 6 Months Salary
JEMBER - The Regent of Jember Faida is back in the spotlight after being sanctioned by the Governor of East Java Khofifah Indar Parawansa. Now Faida cannot receive a salary or allowance for 6 months.
Regent Faida initially had a conflict with the Jember DPRD. He was impeached at the right to express opinion (HMP) plenary session on Wednesday, July 22.
This disharmonious relationship began when the Jember DPRD exercised the right of interpellation on December 27, 2019.
One day before the trial was held, Faida sent a letter to the DPRD asking for the plenary session to be rescheduled. There were several reasons for Faida at that time, namely because Jember had the status of an extraordinary Hepatitis A incident (KLB) since December 26, 2019.
Another reason is that Faida claims to have a schedule with the community that cannot be postponed until December 31, 2019.
Three months passed. On March 20, 2020, the Jember DPRD again exercised its constitutional rights, namely the right to inquiry. Again, Faida was reluctant to attend the summons from the Jember DPRD. Even at that time, Faida ordered all OPDs not to attend the invitation of the DPRD Questionnaire Committee.
The Jember DPRD assessed that Faida's reasons were deliberately fabricated and considered insulting the council. The DPRD held the right of interpellation because they thought Faida had committed serious violations of the prevailing laws.
First, the policy which resulted in the Jember Regency Government not obtaining the 2019 CPNS formation quota. Second, the ASN mutation policy in the Jember Regency Government which allegedly did not comply with the provisions of the Act.
Third, the issuance and promulgation of the Jember Regent Regulation concerning the Position, Composition, Organization, Duties and Functions (KSOTK) of the 30 OPD Jember Regency Government on January 3, 2019, which allegedly violated government regulations.
Fourth, policies regarding the procurement of goods and services that are suspected of violating the provisions. Fifth, other policies that have a broad impact on society, such as arbitrarily deciding the Covid-19 budget without a meeting with the DPRD to end the inquiry rights process.
In addition, Faida often acts unilaterally, including cutting the council's budget post quite significantly. Before being impeached, thousands of Jember residents also demonstrated demanding that Faida be removed from his position.
The demonstrators considered Faida to be incapable of managing the APBD and poor communication and failed to build synergy with the Jember DPRD. The chaotic bureaucracy that is suspected of being involved in corruption is the reason Jember residents ask Faida to be impeached.
As a result, the Jember DPRD impeached Faida through the Plenary Session of the Right to Express Opinion (HMP), on Wednesday, July 22, 2020. Of the total 50 DPRD members, 44 attended. All the participants from the seven factions agreed to propose the dismissal of the Regent of Jember Faida. Now, Faida is the only female regent in Indonesia to be impeached by the DPRD.
Impeachment means political dismissal, but Faida is still officially a regent. Wait for the Fatwa of the Supreme Court in accordance with the provisions of Law Number 23 of 2014 concerning Regional Government.
The MA has 30 days to test impeachment material. If the Supreme Court states that the impeachment is legal, the Jember DPRD proposes the Minister of Home Affairs to dismiss Faida.
The Minister of Home Affairs has 30 days to process it. Thus, it will still take at least the next 60 days or until September to officially terminate Faida if the MA approves. However, until now the Supreme Court has not issued a fatwa.
However, the Governor of East Java, Khofifah Indar Parawansa, gave administrative sanctions to the Regent of Jember Faida. This administrative sanction is in the form of not being paid for Faida's financial rights for six months.
"Because the regulations are like that," said Khofifah, at the Grahadi building, Surabaya, Tuesday, September 8.
Sanctions against Faida are contained in letter number 700/1713/060/2020 concerning the imposition of administrative sanctions to the Regent of Jember. The decision was signed by the Governor of East Java Khofifah on September 2, 2020 in Surabaya.
Khofifah stated that the sanctions were in accordance with the regulations in the law, applied to all regional heads in Indonesia who were late, processing the formation of the Raperda on the Temporary Budget Ceiling Priority General Policy (KUA PPAS).
"The regulation applies not only to the Regent of Jember, to all regional heads in Indonesia," he explained.
As a result of this sanction, the Regent of Jember Faida was unable to receive financial rights, such as basic salary, job allowances, and other benefits such as honoraria, operational support costs and other financial rights in accordance with statutory regulations.
Faida is an incumbent who returns to the 2020 Pilkada through independent channels. He registered with the Jember KPU along with the Deputy Regent of Jember, Dwi Arya Nugraha Oktavianto, on Sunday, February 23.
Faida explained that the reason for progressing from the independent path was because there were no political parties that supported it. Faida also claimed that she had the support of 246,133 residents who submitted photocopies of their electronic ID cards.
