Termination Of The Case Of Sundanese Arteria Dahlan, Lemkapi: It's Been A Long Process
JAKARTA - Executive Director of the Indonesian Police Strategic Studies Institute (Lemkapi) Dr. Edi Hasibuan assessed that the termination of the "Sundanese" case filed by member of the Indonesian House of Representatives, Arteria Dahlan, had gone through a long process.
"We see that the decision was taken after going through a long process. Investigators have conducted a case and asked for information from many experts, both experts in criminal law, language and information technology," he said, quoted by Antara, Saturday, February 5.
In his written statement, Edi emphasized that the decision by the Polda Metro Jaya investigators to not process the criminal proceedings against the member of Commission III of the DPR RI from the PDI-P faction, Arteria Dahlan, was in accordance with the procedure.
He said, as a member of the DPR RI, Arteria has the right to immunity as regulated in Article 224 of the RI Law Number 17 of 2014 concerning the MPR, DPR RI, DPD and DPRD (MD3).
With that right, he said, members of the DPR RI cannot be prosecuted in court regarding their attitudes, actions and activities while carrying out their duties as members of the DPR RI.
"Arteri Dahlan's statement which led to a report to the police was delivered at the official working meeting of the DPR," he emphasized.
Previously, member of Commission III of the DPR RI, Arteria Dahlan, in the Working Meeting of Commission III of the DPR RI with the Attorney General's Office on Monday (17/1) stated that there was a Head of the High Prosecutor's Office (Kajati) who spoke in Sundanese during the work meeting.
Arteria asked Attorney General ST Burhanuddin to replace Kajati who used the Sundanese language. However, Arteria did not reveal the name Kajati was referring to.
This statement prompted the Sundanese Customary Council to report Arteria to the West Java Regional Police, Thursday, January 21, for blasphemy against ethnic groups.
However, the report was submitted to the Polda Metro Jaya because of the incident in Jakarta.
The Head of Public Relations of Polda Metro Jaya Kombes Pol Endra Zulpan in Jakarta, Friday, February 4, said that Arteria Dahlan's statement did not fulfill the element of spreading information containing hate speech based on SARA as regulated in Article 28 Paragraph 2 of Law Number 19 of 2016 concerning ITE.
Zulpan revealed that Arteria has the right of immunity as a member of the council in accordance with Article 224 of the MD3 Law of Law Number 17 of 2014 so that he cannot be prosecuted in court.
Therefore, Zulfan appealed to those who felt aggrieved by these remarks to report to the House of Representatives Honorary Council (MKD).
Arteria has also publicly apologized to the public and is ready to accept sanctions from the party that oversees it.
The PDI-P has warned Arteria for violating the party's ethics and discipline in this case.
