Case Of The Shooting Of 4 TNI Members In West Papua Tried At The Makassar District Court
MAKASSAR - The Makassar District Court, South Sulawesi, tried the case of the shooting of four TNI soldiers at the Kisor Koramil Post, Maybrat Regency, West Papua by six defendants which occurred in September 2021.
The public prosecutor (JPU) Eko Nuryanto said the trial of the shooting of the TNI member at the Makassar District Court was in accordance with a letter from the Supreme Court.
"The trial in Makassar is based on a letter from the Supreme Court. There are many considerations, starting from the examination in Makassar and of course security considerations," he said, quoted by Antara, Monday, January 24.
There are also the defendants in the shooting case, namely Maklon Same alias Pele, Agustinus Yaam, Mikael Yaam, Yakobus Warait, Robianus Yaam, Amos KY, and Lukas KY.
Eko Nuryanto, who is also the Head of the General Criminal Section (Kasi Pidum) of the Sorong District Attorney's Office, stated that the inaugural trial was scheduled to read the indictment.
However, after the trial was opened by the panel of judges, the attorneys for the defendants had not yet completed the administration of their appointment as attorneys, so the case had to be adjourned a week later.
"So, today is the first trial with the agenda of reading the indictment on the six defendants in the case of the murder of TNI members in West Papua," he said.
In the shooting case, they were charged with the primary article, namely Article 340 in conjunction with Article 55 paragraph (1) 1 of the Criminal Code, subsidiary to Article 338 jo. Article 55 paragraph (1) 1st of the Criminal Code or both Article 170 paragraph (2) 3rd or 3rd Article 53 paragraph (3) jo. Article 55 paragraph (1) 1 of the Criminal Code.
The reason for moving the location of the trial in this case from Sorong to Makassar, said Eko, was based on a decision letter from the Supreme Court. In addition, it is also in accordance with Article 85 of the Criminal Procedure Code (KUHAP).
