Sued To PTUN Regarding UMP Revision Of 5.1 Percent, DKI Provincial Government: Must Be Ready, Always Ready
JAKARTA - Several businessmen have filed a lawsuit with the State Administrative Court (PTUN). They asked the Governor of DKI Jakarta Decree No. 1517 regarding the 2022 Jakarta UMP to also pay attention to the fate of entrepreneurs, especially in the post-pandemic situation.
In response to this, the Head of the Legal Bureau of the DKI Jakarta Secretariat, Yayan Yuhanah, said that the DKI Jakarta Provincial Government was ready to face the lawsuit.
"Any lawsuit and the material who is suing, what material the lawsuit is about, must be ready indeed, always ready," said Yayan Yuhanah, quoted from CNNIndonesia, Thursday, January 20.
According to Yayan, there is no mediation in this lawsuit. This is because the lawsuit was filed with the State Administrative Court (PTUN), not the district court.
"Whoever the plaintiff has to face. If the PTUN does not have mediation, except in the district court there is mediation, in the PTUN there is no mediation," he explained.
Recently, the DKI Jakarta Indonesian Employers Association (Apindo) together with PT Edico Utama and PT Century Textile Industri sued the Governor Anies Baswedan's 2022 UMP revision policy to the Jakarta Administrative Court.
The lawsuit was filed with the Administrative Court since January 13 and is registered under Number 11/G/2022/PTUN.JKT. The businessmen appointed Tjoetjoe Sandjaja Hernanto as their legal representative.
"Declaring that the Decree of the Governor (Kepgub) of DKI Jakarta Number 1517 of 2021 concerning the Provincial Minimum Wage (UMP) 2022 is null and void, dated December 16, 2021," reads the petition filed by the entrepreneurs quoted from the Case Tracing Information System (SIPP) of the Jakarta Administrative Court. .
Furthermore, the entrepreneurs also asked the court to declare DKI Jakarta Governor Decree No. 1395 of 2021 concerning the 2022 UMP dated 19 November 2021 to be valid and binding.
The businessmen also asked the court to require Anies to revoke DKI Jakarta Governor Decree No. 1517/2021 regarding UMP 2022 dated 16 December 2021 and declare DKI Jakarta Gubernatorial Decree No. 1395/2021 regarding UMP 2022 dated 19 November 2021 to be valid and binding.
Previously, the Governor of DKI Jakarta Anies Baswedan revised the value of the DKI Jakarta provincial minimum wage (UMP) for 2022 by 5.1 percent. This irritated the business community because they were not involved in setting the regulation.
