Anies Officially Sued To Administrative Court Due To Revision To Increase DKI UMP 5.1 Percent
JAKARTA - The DKI Jakarta Indonesian Employers Association (Apindo) has officially filed a lawsuit against DKI Jakarta Governor Anies Baswedan to the Jakarta State Administrative Court (PTUN).
Apindo sued Anies for revising the increase in the provincial minimum wage (UMP) for DKI in 2022 from 0.85 percent to 5.1 percent.
This lawsuit was registered at case number 11/G/2022/PTUN.JKT dated January 13, 2022. Apart from Apindo, Anies' other plaintiffs are PT Edico Utama and PT Century Textile Industry, Tbk.
In the Case Investigation Information System (SIPP) of the Jakarta Administrative Court, Apindo demanded Anies to revoke the Decree of the Governor of the Special Capital Region of Jakarta Number 1517 of 2021 concerning the 2022 Provincial Minimum Wage on 16 December 2021.
In addition, Apindo asked Anies to return the ratification of the decree regarding the amount of the UMP which was previously set at 0.85 percent.
"Declare that the Decree of the Governor of the Special Capital Region of Jakarta Number 1395 of 2021 concerning the 2022 Provincial Minimum Wage on November 19, 2021 is valid and binding," the lawsuit reads as quoted from the SIPP PTUN website in Jakarta, Monday, January 17.
It is known, Anies issued the Decree of the Governor of DKI Jakarta Number 1517 of 2021 concerning the Provincial Minimum Wage of 2022 with a determination to increase the UMP by 5.1 percent. This Governor Decree is a revision of the previous Governor Decree regarding the determination of the UMP.
Anies made the determination of the revised UMP without referring to the legal basis set by the central government. It is known, the Ministry of Manpower has set a formula for increasing the UMP to local governments based on Government Regulation No. 36 of 2021.
Anies uses three legal grounds in determining the revised UMP. First, Anies uses Law No. 29 of 2007 concerning the DKI Jakarta Government as the capital city of the Republic of Indonesia.
The second is Law Number 23 of 2014 concerning Regional Government which was amended several times in the Job Creation Law Number 11 of 2020.
The third is Law Number 30 of 2014 concerning Government Administration which was amended in the Job Creation Law Number 11 of 2020.
