2 Defendants Of Rp2.6 Billion Chicken Egg Corruption In Aceh Request Release
JAKARTA - Two defendants of alleged corruption resulting from the sale of chicken eggs reached Rp. 2.6 billion at the Aceh Livestock Service Office, asking to be acquitted of all charges.
The request was conveyed by defendants Ramli Hasan and Muhammad Nasir in a defense note at the trial at the Banda Aceh Corruption Court, reported by Antara, Friday, August 28.
In a trial with a panel of judges chaired by Dahlan accompanied by Edwar and Juandra, respectively as member judges, the two defendants were accompanied by their legal advisers Junaidi and Jalaluddin and general prosecutor (JPU) Taqdirullah from the Aceh Besar District Attorney.
Junaidi, the legal adviser to the defendant Muhammad Nasir, said that based on the facts at the trial, his client was not found guilty of committing a criminal act of corruption as charged by the public prosecutor.
"Our clients are only subordinates of the defendant Ramli Hasan at the UPTD BTNR of the Aceh Livestock Service Office in Saree, Aceh Besar. Our clients carry out their duties according to the rules and directions of their superiors," said Junaidi.
Junaidi said the defendant Muhammad Nasir was not the person who managed the money from the sale of chicken eggs to the Regional Technical Implementation Unit of the Non-Ruminant Livestock Center (UPTD BTNR) of the Aceh Livestock Service Office in Saree, Aceh Besar.
However, said Junaidi, the defendant Muhammad Nasir was assigned to buy feed using the money from selling chicken eggs. Purchase of feed to save 45 thousand chickens at the UPTD BTNR Saree.
"With the provision of feed for tens of thousands of chickens, our client managed to save the state money reaching Rp. 10.6 billion from the sales of 11 million eggs in the 2016 to 2018 period," said Junaidi.
According to Junaidi, feed purchases were made, because there was no budget allocation for buying animal feed. Based on expert testimony at the trial, the money from selling chickens can be used as long as it is for urgent needs.
Apart from that, said Junaidi, the public prosecutor could not prove that the defendant Muhammad Nasir enriched himself with money from selling eggs. As a result of the audit, no money from selling eggs flowed to the defendant.
"Based on the facts at the trial, we ask the panel of judges to declare the defendant Muhammad Nasir not proven to have committed a criminal act of corruption of money from selling eggs at the UPTD BTNR Sare, and to release the defendant Muhammad Nasir of all charges," said Junaidi.
The defendant Ramli Hasan also submitted a request to be free from all charges, through his legal adviser Jalaluddin
"We request that the defendant Ramli Hasan be acquitted of all charges by the public prosecutor, because the defendant is not proven to have committed a criminal act of corruption as charged. The money from the sale of UPTD BTNR Saree chicken eggs is used to buy feed," said Jalaluddin.
In the previous trial, the public prosecutor charged the defendant Ramli Hasan and the defendant Muhammad Nasir with eight years each, because they were proven to have committed a criminal act of corruption resulting from the sale of chicken eggs amounting to Rp.
The public prosecutor found the two defendants guilty of violating Article 2 paragraph (1) in conjunction with Article 18 (1) letters a, b, paragraph (2) and paragraph (3) of Law Number 31 Year 1999 as amended by Law Number 20 Year 2001 concerning the Eradication of Acts Corruption Crime
According to the prosecutor, the chicken eggs were produced by the UPTD of the Aceh Livestock Service Office for Non-Ruminants (BTNR) in Saree, Aceh Besar. The crime was committed in 2016 to 2018.
The defendant Ramli Hasan was the Head of the BTNR Saree Regional Technical Implementation Unit (UPTD). Meanwhile, the defendant Muhammad Nasir was the defendant's subordinate Ramli Hasan.
Apart from imprisonment, the public prosecutor also demanded that the two defendants pay a fine of Rp. 300 million each with a subsidy of three months in prison.
For the defendant Ramli Hasan, the public prosecutor demanded to pay compensation of Rp2.6 billion. If you do not pay after the case has permanent legal force, the prosecutor will demand that the defendant's property be confiscated.
