Inspector General Napoleon Has Not Been Detained, Polri Affirms The Prerogative Of Investigators

JAKARTA - Bareskrim Polri has dismissed the suspicion that Inspector General Napoleon Bonaparte was not detained because he was a two-star general. The detention of the suspect in the case of alleged bribery for the removal of Djoko Tjandra's red notice is called the investigator's authority.

"Oh no, we don't exist (because the General). Pure all the investigative processes, all prerogatives," said Karo Penmas, Police Public Relations Division, Brigadier General Awi Setiyono to reporters, Friday, August 28.

The investigator called Awi thought that Inspector General Napoleon was cooperative. Moreover, in detention decisions, the investigator's authority is regulated in the Criminal Procedure Code.

"Investigators of course still adhere to the Criminal Procedure Code, there have been stipulated that whether to detain a person or not there are subjective and objective requirements," said Awi.

Awi then gave an example of the detention of Brigadier General Prasetyo Utomo, who was also a suspect in connection with Djoko Tjandra. Brigadier General Prasetyo was detained at the Salemba Detention Center, Bareskrim branch.

"I added that previously was another case, in which the other two suspects were arrested because of a fake passport case," said Awi.

Inspector General Napoleon and Brigadier General Prasetyo have been named as suspects in the bribery for the removal of red notice Djoko Tjandra.

They are charged with Article 5 Paragraph 2, Article 11 and Article 12 letters a and b of Law Number 20 of 2020 concerning Corruption (Tipikor) in conjunction with Article 55 of the Criminal Code.

Meanwhile, Tommy Sumardi was named a suspect on suspicion of grafting bribes. Thus, Tommy is charged with Article 5 Paragraph 1, Article 13 of Law 20/2020 concerning Corruption (Tipikor) in conjunction with Article 55 of the Criminal Code.

In the bribery case, investigators confiscated US $ 20 thousand, cellphones, including CCTV as evidence.
