MEDAN - The former regent of South Labuhan (Labusel) North Sumatra Wildan Aswan Tanjung was sentenced to 18 months in prison.
In the indictment, the prosecutor stated that the defendant was judged to be legally proven guilty and confirmed the corruption of the incentive money for collecting the Land and Building Tax (PBB) worth Rp. 1.9 billion.
"Ask the panel of judges to try and examine this case. To sentence the defendant Wildan Aswan Tanjung to a prison term of 1 year and 6 months," said Hendri at the trial at the Medan District Court, Wednesday, January 12.
In addition to the prison sentence, the defendant is required to pay a fine of Rp. 100 million.
"If after it is decided not to pay the fine, it will be replaced with imprisonment for 3 months," Hendri said in the virtual trial.
The prosecutor stated that the defendant's actions were found guilty of violating Article 3 in conjunction with Article 18 paragraph (1) letter b of the Law of the Republic of Indonesia Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended and added to the Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to the Law. -Law Number 31 of 1999 concerning the Eradication of Corruption Crimes Jo. Article 55 Paragraph (1) The 1e of the Criminal Code are subsidiary charges.
After hearing the note on the prosecution's demands, the panel of judges postponed the trial for the next week to give the defendant the opportunity to present a defense or plea.
Quoting from the indictment, the Public Prosecutor said that Wildan Aswan Tanjung was charged with corruption using the PBB collection incentive money, the plantation sector from the central government to be used as additional income.
In the indictment, this corruption case, which began in the 2013 to 2015 fiscal year, the Labusel Regency Government received the tax collection fees for the plantation sector from the central government, which amounted to billions of rupiah per year.
However, the cost of collecting PBB from the plantation sector for the 2013 to 2015 fiscal years, which was received by Labusel Regency, turned out to be used by the defendant Wildan Aswan Tanjung as regent with witnesses Marahalim Harahap and Salatielo Laoli.
On May 23, 2013 the defendant H Wildan Aswan Tanjung as the Regent of South Labuhanbatu agreed to use the UN incentive funds for the plantation sector received by the South Labuhanbatu Regency along with witness Marahalim Harahap and witness Salatieli Laoli as additional income.
Even though they know that the Labusel Regency Government does not have the task and authority to receive or use incentive funds as additional income, because the collection of PBB in the plantation sector is the duty and authority of the central government in this case the Directorate General of Taxes.
Then, to implement the desire to use PBB incentive funds for the plantation sector as additional income, the defendant H Wildan Aswan Tanjung signed the South Labuhanbatu Regent's Order Number: 821.24/1165/BKD/II/2013 which appointed the defendant Marahalim Harahap as Acting Head of the Revenue, Financial Management Office. and Regional Assets of Labusel Regency.
In the regent's regulation, it is explained about the use and procedure for distributing PBB collection fees, it states that the distribution of the incentive costs for collecting PBB for the plantation and forestry sector is 25 percent for the regent, 15 percent for the deputy regent, 15 percent for the Regional Secretary and the Revenue, Financial and Asset Management Office. 45 percent area.
Collection of land and building tax from the plantation sector as an incentive has violated the principle of propriety and benefit for the community where according to the definition, incentives for collecting taxes and levies are additional income that is given as a reward for certain performance in carrying out tax and levy collections.
Meanwhile, the regions have no role and do not collect PBB in the plantation sector.
