In Addition To The Death Penalty, The Prosecutor Demands That The Assets Of The Rapists Of 13 Female Students Be Auctioned For The Victim's Living Expenses

BANDUNG - The West Java High Prosecutor's Office (Kejati) demanded that the assets of the accused rape 13 female students, namely Herry Wirawan, be confiscated and auctioned off for the living expenses of the victims and the babies they were born with.

Head of the West Java Prosecutor's Office, Asep N Mulyana, said that in order to conduct the auction, the prosecutor demanded that the permit for the Herry Islamic boarding school foundation be frozen and revoked. Then Herry's assets and wealth were seized for confiscation.

"What was confiscated is to be auctioned off, and handed over to the state or West Java Provincial Government, which will then be used for the school fees of the children (victims) plus their babies, and their survival," said Asep as Public Prosecutor at the Bandung District Court, West Java, reported by Antara, Tuesday, January 11.

Herry is also required to pay a fine of Rp. 500 million, subsidiary to one year in prison and is also required to pay restitution of Rp. 331 million to the victims.

Apart from the demands for material matters, the immoral perpetrator was also demanded to be sentenced to death. Herry was also demanded to be punished with chemical castration as a deterrent effect. According to Asep, Herry's actions had a tremendous impact because of the emergence of unrest in the community. In addition, the victims also experienced social impacts due to Herry's commendable actions.

"The defendant's actions not only affect the physical honor, but also affect the psychology and emotions of the students as a whole," he said.

Herry was charged with guilt in accordance with Article 81 paragraph (1), paragraph (3) and (5) in conjunction with Article 76D of the Republic of Indonesia Law Number 17 of 2016 concerning Amendments to Law Number 23 of 2002 concerning Child Protection in conjunction with Article 65 paragraph (1) of the Criminal Code as the first indictment.
