Attorney's Legal Assistance Related To The Pinangki Case Condemned

JAKARTA - Indonesia Corruption Watch (ICW) condemns the decision of the Attorney General's Office (Kejagung) to provide legal assistance to Attorney Pinangki Sirna Malasari in a case of alleged gratification in the form of receiving a gift from Djoko Tjandra.

Of course, the AGO has not provided legal assistance to Pinangki, the prosecutor who has tarnished the image of the Adhiyaksa Corps.

"ICW criticizes the legal assistance provided by the Attorney General's Office for Attorney Pinangki Sirna Malasari," said ICW researcher Kurnia Ramadhana in his statement, Tuesday, August 18.

According to him, legal assistance will have an impact on the investigation of this case which is not objective. Though this should be avoided.

"There is a concern that the legal assistance will be used to protect Attorney Pinangki from being caught in the trap of the law," said Kurnia.

On the other hand, he considered, legal assistance is suspected of contradicting the articles of association and household (AD / ART) of the Indonesian Prosecutors Association (PJI). This is because the regulation states that the objective of PJI is to increase the integrity and professionalism of prosecutors in accordance with their duties and responsibilities as law enforcers.

In addition, referring to Article 2 of the AD / ART, it is stated that it also aims to defend and assist members who face legal problems related to their professional duties.

However, in the Pinangki case, he was not carrying out his duties and profession as a prosecutor. This is because the meeting with Djoko Tjandra was not based on the approval of his superior.

With some of these things, said Kurnia, his party suspected that the provision of legal assistance would have an impact on the case not progressing or halting the involvement of Pinangki alone.

In fact, the AGO has a legal obligation to investigate whether there are high-ranking AGO officials suspected of knowing about the meeting between Prosecutor Pinangki and Djoko Tjandra.

"On this basis, ICW demands that the Attorney General's Office immediately revoke the decision to provide legal assistance to Prosecutor Pinangki Sirna Malasari," said Kurnia.

Previously, the Attorney General's Office would provide a legal trial against Pinangki Sirna Malasari for the alleged gratification case from Djoko Tjandra. This legal hearing was reasonable because Pinangki was still an employee of the Indonesian Prosecutor's Office when he was named a suspect.

In addition, Pinangki is also a member of the Indonesian Prosecutors Association, so he is entitled to legal assistance.

Meanwhile, Pinangki is suspected of receiving a bribe of 500 thousand US dollars. He was suspected of being under Article 5 letter b of the Corruption Crime Law.
