Surabaya Satpol PP Seals 5 Telecommunication Towers Not Pocketing IMB

SURABAYA - The Civil Service Police Unit (Satpol PP) of Surabaya City, East Java, sealed five telecommunication towers in Lakarsantri and Sambikerep sub-districts, Surabaya City. The sealing was done because the tower did not have a building permit (IMB).

"They have received a warning letter and administrative sanctions from the Cipta Karya and Spatial Planning Service. In relation to this sealing, we have been close to inviting the relevant OPD, the prosecutor's office, and resource persons," said Head of Enforcement of the Surabaya City Satpol PP Regional Regulations Siti Nurhayati during the sealing, quoted by Antara. At the first location, the Satpol PP visited the telecommunications tower building on Jalan North Emerald Mansion TN 2 No. 3 City of Surabaya. When they were about to seal it at the first location, the Satpol PP had a refusal from the lawyer for the telecommunications tower owner.

However, after conveying the intent and purpose and showing the warrant, the sealing of the telecommunications tower took place in an orderly manner and without resistance. Satpol PP then secured several cables as evidence.

The group then shifted to the second location, namely at Jalan Villa Taman Telaga Blok TJ 1 No. 33, to seal telecommunications towers. Next, the group headed to the Taman Gapura Shophouse Block A No. +1 for doing the same.

Fourth location, the group headed to Jalan North Junction Blok RB No. 28 and the fifth location, is at Jalan Waterfront Blok WP 3 No. 51/51 for sealing telecommunication towers that do not have a tower construction permit

According to Yati, who is Siti Nurhayati's nickname, the sealing by her staff is a follow-up to a letter of assistance for controlling (bantib) from the Public Housing and Settlement Areas, Cipta Karya and Spatial Planning (DPRKP-CKTR) Surabaya office related to telecommunications towers that do not have an IMB.

Yati explained that the owner of the telecommunications tower had filed a lawsuit against the administrative sanctions that had been given by the Cipta Karya and Spatial Planning Service. However, the objection was rejected by the Department of Human Settlements and Spatial Planning.

"They then appealed to the mayor (Eri Cahyadi). However, the objection was also rejected. In the end, it became the basis for enforcing the regional regulation related to telecommunications towers that do not have an IMB so that the sealing process continues today," he said.

On the other hand, Yati said that his party had tried to respect and appreciate the owner of the telecommunication tower in relation to the effort to file an administrative appeal. However, the owner of the telecommunications tower assumes that the tower is non-cellular.

"Both cellular and non-cellular phones must have an IMB. The second assumption is that they have a permit from the Diskominfo (Communication and Information Office). However, it is only an operational permit. In fact, according to Perda Number 7 of 2019 it is stated that the IMB is subject to any type of building , both buildings and non-building buildings," he said.

Yati added that the owner of the telecommunications tower had filed a lawsuit with the Surabaya City Administrative Court (PTUN). However, based on Article 67 of Law no. 5 of 1986 concerning the State Administrative Court reads that the lawsuit does not delay or hinder the implementation of the decisions of the State Administration agency or official as well as the actions of the State Administration agency or official being sued.
