DPR Considers Rape Case Of Students Can Be Momentum To Accelerate Ratification Of The Revised Criminal Code And TPKS Bill

JAKARTA - Chairman of Commission VIII of the DPR RI, Yandri Susanto, considers the case of sexual violence that befell a number of female students in Bandung could be momentum to accelerate the two regulations that are being drafted by the government and the DPR.

The two regulations are the Revised Criminal Code (RKUHP) and the Draft Sexual Violence Criminal Act (RUU TPKS).

"If you want, this can be used as momentum. The revision of the Criminal Code is still pending at Commission III. Now, this is used as a momentum to increase penalties, including the TPKS Bill," Yandri said in a virtual discussion, Sunday, December 12.

Currently, the TPKS Bill has now been approved by the Legislation Body (Baleg) of the DPR RI. A total of seven out of nine factions agreed that the draft TPKS Bill was taken to the next level to be proposed as an initiative by the DPR RI.

Furthermore, if it has been determined as a proposed initiative by the DPR RI, the draft TPKS Bill will be discussed with the government and then ratified as a law.

Yandri explained that the obstacle that made it difficult to accelerate the ratification of the TPKS Bill was the revision of the Criminal Code which had not yet been ratified. Thus, the elements of punishment contained in the Criminal Code to be included in the TPKS Bill are hampered.

"The revision of the Criminal Code and the TPKS Bill are two sides of a coin that cannot be separated. If you want, this can be used as momentum, let's quickly revise the Criminal Code so that it is in line with the TPKS Bill," said Yandri.

For information, the case of the rape of female students began to be revealed since a report was made around May 2021 to the West Java Regional Police. After that, the report is followed up with investigations and investigations until the case file is complete and transferred to the prosecutor's office.

From this case, it is known that a teacher with the initials HW committed immoral acts on 12 female students. There are even female students who are pregnant and have given birth to several children.

HW is also the owner of one of the Islamic boarding schools in Bandung. He now has the status of a defendant because his case file has been entered in court.
