Mother-Child Murderer In Kupang Charged With Article 338 Of The Criminal Code, Victim's Family Still Objects

KUPANG - Families of victims of the murder of mother and child in Kupang City, East Nusa Tenggara, have asked law enforcement to charge the perpetrator with premeditated murder because it is in accordance with his actions.

"The victim's family is very disappointed with the application of Article 338 by the NTT Police investigators to the perpetrator, because the perpetrator's actions were clearly planned," said the attorney for the victim's family, Adhitya Nasution, in a statement received in Kupang, Monday, December 6.

He said this was related to the response of the victim's family to the application of the legal article by the NTT Regional Police investigators to the perpetrator in the mother-child murder case at the Kupang SPAM project site.

The NTT Police investigators ensnared the perpetrator with a violation of Article 338 of the Criminal Code (KUHP) with a penalty of 15 years in prison.

Adhitya said the family was disappointed with the application of the legal article because the victims in this case were mother and child. Killing a mother and child, he said, could not only be rewarded with 15 years in prison.

On the other hand, he said, there was no guilt from the perpetrator's family or the perpetrator himself for not apologizing to the victim's family, even though the victim's family and the perpetrator knew each other.

Adhitya said the perpetrator's action was a planned crime because it started from picking up the victim to being killed and hidden.

"For the families of the victims, all of these actions have been planned and all the evidence presented by the families has led very clearly to Article 340 of the Criminal Code, namely premeditated murder," he said as quoted by Antara.

Adhitya said the victim's family asked the NTT Police investigators to be more thorough and transparent in looking at this incident, including looking at the sadistic level of the perpetrator who took two lives.

If the NTT Regional Police investigators continue to apply Article 338, he said, the family will take legal action to fight for justice for their deceased children and grandchildren. Previously, the Police had named RB as a suspect in the murder case of a mother and child whose bodies were found wrapped in bags. by workers of the Kali Dendeng SPAM pipeline excavation project, Kupang City.

"So after turning himself in on Thursday, December 2 a few days ago, the investigative team then conducted an examination and on Friday night December 3 last night RB was immediately named a suspect," said Head of Public Relations of the NTT Police, Police Commissioner Rishian Krisna.

After being named a suspect in the murder case, RB was immediately detained at the NTT Police Rutan for the next 20 days.
