2 Chicken Egg Corruption Accused Charged 8 Years In Prison
BANDA ACEH - Two people accused of corruption resulting from the sale of chicken eggs were charged 8 years in prison each. The prosecutor believed that the defendant committed corruption with a state loss of Rp. 2.6 billion.
The demand was read out by Public Prosecutor (JPU) Endi Ronaldi and Taqdirullah during a hearing at the Banda Aceh District Court, Wednesday. The trial was chaired by Chief Judge Dahlan and accompanied by two member judges, Edwar and Juandra.
The two defendants were Ramli Hasan, former Head of the Regional Technical Implementation Unit (UPTD) of the Aceh Animal Husbandry Office (BTNR) of the Aceh Livestock Service Office in Saree, Aceh Besar and Muhammad Nasir, staff of the UPTD BTNR Saree. The defendant Muhammad Nasir was the defendant's subordinate Ramli Hasan.
The defendant Muhammad Nasir was present at the trial accompanied by his legal advisor Junaidi. Meanwhile, the defendant Ramli Hasan was accompanied by Jalaluddin.
In addition to demanding eight years in prison, the prosecutor also demanded that the two defendants pay a fine of Rp. 300 million each with a subsidy of three months in prison.
Especially for the defendant Ramli Hasan, the prosecutor demanded to pay a replacement fee of Rp2.6 billion. If the defendant does not pay after the case has permanent legal force, his property is confiscated.
"If the defendant does not have property, then he will be sentenced to three years and six months. If the defendant pays state losses, but the amount is insufficient, the sentence period will be adjusted based on the amount paid," said Prosecutor Endi Ronaldi.
Prosecutor Endi Ronaldi found both guilty of violating Article 2 Paragraph (1) in conjunction with Article 18 (1) Letter a, b, Paragraph (2), and Paragraph (3) of Law Number 31 Year 1999 as amended by Law Number 20 Year 2001 concerning Eradication Corruption Crime.
After reading the demands of the public prosecutor, the panel of judges gave the two defendants and their legal advisers two weeks to prepare a defense.
Responding to the prosecutor's demands, Junaidi, the legal adviser to the defendant Muhammad Nasir, said the prosecutors' demands were too excessive. The prosecutor did not consider the facts of the trial at all.
Junaidi said the client used the money from selling eggs to buy feed and vaccines. If there is no feed and vaccines, thousands of chickens at the UPTD BTNR Aceh Animal Husbandry Service are in danger of dying.
"If the chickens die, the potential for state losses will reach tens of billions. At the UPTD, there are tens of thousands of chickens. Our clients, experience it directly in the field. "said Junaidi.
The defendant Ramli Hasan and the defendant Muhammad Nasir were charged with corruption of money proceeds from selling eggs produced by livestock at the BTNR UPTD of the Aceh Livestock Service Office in Saree, Aceh Besar, with a state loss of up to Rp2.6 billion.
The prosecutor stated that the criminal acts of corruption committed by the two defendants did not deposit money from chicken production to the regional treasury between 2016 and 2018.
Supposedly, the money from selling eggs should be included as regional income. But this was not done by the defendant. As a result of the defendant's actions, the state suffered losses of more than Rp. 2.6 billion.
Based on the results of an audit by the Aceh Representative Financial and Development Supervisory Agency (BPKP), the revenue from selling eggs in 2016 was IDR 846 million. However, what was paid into the state treasury was Rp. 85 million.
Then in 2017, the money from the sale of eggs was Rp.668 million, but that was paid into the state treasury Rp. 60 million. And in 2018, the money from the sale of eggs was Rp. 11.72 billion and which was deposited into the state treasury Rp. 9.775 billion.
