Reflecting On The Case That Befell Nirina Zubir, BPN Reminds People To Increase Vigilance To Avoid Land Mafia Mode

JAKARTA - The land mafia is still rampant. Therefore, the Ministry of Agrarian and Spatial Planning/National Land Agency (ATR/BPN) is serious about fighting the practice of land mafia. Even so, BPN reminds the public to take precautionary aspects to avoid the land mafia mode. Among them is the need for care and vigilance of land owners.

The Director General (Dirjen) of Land Dispute and Conflict Handling (PSKP) of the Ministry of ATR/BPN, RB Agus Widjayanto, said that it was not easy for BPN to anticipate if the land certificate was submitted for transfer of name.

"It is also necessary for the land owner to take preventive measures, for example giving a power of attorney, first study the power of attorney document that was made, and do not easily hand over the certificate to other people," he said in a written statement, Monday, November 22.

Agus said that in the case of changing the name of the land certificate, it is necessary to look at whether there are deficiencies or defects because they did not go through the procedure. This is what is called an administrative defect. Due to administrative defects, the transfer process can also be canceled.

"When there is an administrative defect, even though the administrative procedure stages are passed, it turns out that the transfer of rights is based on the required documents. However, the document turns out to be illegal or illegitimate so that the legal act of buying and selling also becomes invalid," he said.

In addition, Agus said, if the buying and selling process is carried out by people who do not have this authority, it can be called a legal defect.

"We can cancel this sale and purchase so that it is called a legal or juridical defect. But to be able to return it to its original state, BPN will examine whether there is really a defect in its administration. This is what the police are currently proving," he said.

Furthermore, Agus said that the Land Deed Making Officer (PPAT) is an extension of the Ministry of ATR/BPN which has been delegated the authority to make land deeds. So the role of PPAT is very necessary in terms of making a deed of sale and purchase of land, to ensure that the parties who make the sale and purchase are correct.

"PPAT must ensure that the parties who will conduct the transaction when making the deed of sale and purchase, are they the rightful and authorized parties to carry out the sale and purchase transaction. The parties who carry out the sale and purchase must be together before PPAT when making the deed, the deed is read out. With Thus, the parties really believe in themselves," he said.

In an effort to combat the practice of land mafias, Agus said, the government has formed a Task Force or Anti-Land Mafia Task Force in collaboration with the Police and the Attorney General's Office. The team was formed since 2018. This team has handled more than 80 land cases indicated by the land mafia.
