Jokowi Revokes The Presidential Decree On The Dismissal Of KPU Member Evi Novida
JAKARTA - President Joko Widodo will revoke Presidential Decree (Keppres) Number 34 / P / 2020 concerning the dishonorable discharge of a member of the KPU for the 2017-2022 period, Evi Novida Ginting. Jokowi decided not to appeal.
"The President respects and respects the decision of the State Administrative Court (PTUN) and has decided not to appeal. The President will issue a decision to revoke the Presidential Decree dismissing Evi Novida as a member of the KPU as a follow-up to the PTUN decision," said the special staff to the President for Legal Affairs, Dini Purwono, quoted by Antara , Friday, August 7.
According to him, Jokowi's consideration to revoke the Presidential Decree was based on the administrative nature of the Presidential Decree.
"The Presidential Decree is solely for formalizing the DKPP decision. Presidential Decree No. 34 / P / 2020 regarding the dismissal of Evi Novida was issued based on the DKPP decision and therefore the substance of the case is in the DKPP decision, not in the presidential decree," he said.
Jokowi, according to him, also considered that the PTUN had examined the substance of the case including the DKPP decision against Novida and decided to cancel the dismissal.
"Given the nature of the Presidential Decree is administrative, the president does not see any reason not to accept the PTUN decision, the substance of dismissal is returned to DKPP," continued Dini.
On July 23, 2020, the Jakarta Administrative Court decided to grant Novida's lawsuit against Keppres 34 / P / 2020 which dishonorably dismissed him as of March 23, 2020.
Novida was fired from his position as a member of the KPU by the Honorary Board of Election Administrators (DKPP) in connection with a dispute over the vote acquisition of candidates for the West Kalimantan Provincial DPRD for the Electoral District of West Kalimantan 6 from the Gerindra Party.
In addition, DKPP also gave sanctions in the form of stern warnings to the chairman and four other members of the KPU.
DKPP thinks he should have greater ethical responsibility for lawlessness and unfairness in determining election results, given his position as Coordinator of the General Election Implementation and Logistics Technical Division.
Ethical sanctions in the form of stern warnings accompanied by dismissal from the Division Coordinator, are a category of serious code violations which indicate that their performance cannot be accounted for.
