In North Sumatra, Attorney General Burhanuddin Leads The Dismissal Of Cases Of Kikil Traders Hitting Buyers

JAKARTA - Attorney General Sanitiar Burhanuddin during a working visit at the Deli Serdang District Attorney, North Sumatra, led the issuance of the Termination of Prosecution Decree (SKP2) to the suspect in the case of molestation against the gravel meat buyer.

The Head of the Legal Information Center (Kapuspenkum) of the Attorney General's Office, Leonard Eben Ezer Simanjuntak, said that SKP2 was given by the Head of the Deli Serdang District Attorney's Office to the suspect Basri Sihaloho.

"The decision to terminate the prosecution based on restorative justice issued by the Head of the Deli Serdang District Attorney was given after mediation was carried out and peace was made," Leonard said in a written statement received in Jakarta, reported by Antara, Friday, November 12.

This incident occurred on Thursday, October 7 at around 18.00 WIB at Market XIV, Hamlet VII, Limau Manis Village, Tanjung Morawa District, Deli Serdang Regency, North Sumatra Province.

On that day there was a debate between victim witness Melda Nova Sembiring (as the buyer) who offered to buy the weighted price of gravel meat and the suspect Hasan Basri Sihaloho (as a meat trader/seller).

As a result of the bargaining, the suspect Hasan Basri Sihaloho became emotional and hit the victim's witness Melda Nova Sembiring once with his right hand which hit the right jawbone of the victim's witness, so that the victim's witness suffered bruises on the jawbone on the right side of the face.

The actions of the suspect Hasan Basri Sihaloho were reported to the police and have been declared complete and the suspect has been transferred to the Deli Serdang District Attorney by investigators. The suspect is Hasan Basri Sihaloho under Article 351 of the Criminal Code.

"Between the victim's witness Melda Nova Sembiring and the suspect Hasan Basri Sihaloho, a peace has been made. The victim's witness Melda Nova Sembiring has withdrawn his report to the Tanjung Morawa Police," said Leonard.

After giving SKP2 to the suspect from the Head of the Deli Serdang District Attorney, the suspect immediately apologized to the victim's witness and her husband, witnessed by investigators and community leaders.

On that occasion, Attorney General Buhanuddin delivered a special message to the suspect and victim witnesses.

"To the suspect, the Attorney General conveyed that by submitting SKP2, starting today the suspect can be released and reunited with his family and the case has been terminated based on restorative justice," said Leonard. and his sincerity to apologize to the suspect, thus asking the suspect not to do the same thing again in the future and continue to establish friendship with the victim.

To the witness korhan, the Attorney General expressed his gratitude for his willingness and sincerity in apologizing to the suspect, so that this case can be terminated based on restorative justice.

"The Attorney General also said that with the issuance of Guidelines Number 15 of 2020, it shows that the law is no longer sharp downwards but the law must be sharp up and blunt down, because restorative justice touches the sense of justice in small communities," said Leonard.

Leonard added, during the working visit, the Attorney General was present to see and directly monitor the process of stopping prosecutions based on restorative justice in several areas, and always reminded all prosecutors and prosecutors' employees not to commit disgraceful acts in the implementation of the restorative justice process.
