Former Pelindo II President Director RJ Lino Sued 6 Years In Prison
JAKARTA - Former President Director of PT Pelabuhan Indonesia II (Persero) Richard Joost Lino alias RJ Lino was sentenced to 6 years in prison plus a fine of IDR 500 million subsidiary 6 months in prison.
RJ Lino was accused of corruption in the procurement and maintenance of 3 Quayside Container Crane (QCC) units in 2010 at the ports of Panjang (Lampung), Pontianak (West Kalimantan) and Palembang (South Sumatra).
"Demanding that the panel of judges in the court of corruption (Tipikor) declare that the defendant Richard Joost Lino is proven legally and convincingly guilty of committing a criminal act of corruption jointly by benefiting oneself or others which results in state financial losses. Sentencing the defendant with a criminal offense imprisonment for 6 years plus a fine of Rp. 500 million, subsidiary to 6 months in prison," said KPK Public Prosecutor (JPU) Wawan Yunarwanto at the Jakarta Corruption Court (Tipikor) quoted by Antara, Thursday, November 11.
The claim is based on the second alternative indictment of Article 3 of Law no. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Corruption Crimes in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
The KPK prosecutor did not ask that RJ Lino be sentenced to pay replacement money.
"Charging replacement money to China's Wuxi Hua Dong Heavy Machinery Science and Technology Group Co. Ltd. (HDHM) amounting to 1,997,740,23 US dollars," prosecutor Wawan added.
There are a number of aggravating things in RJ Lino's actions.
"The situation is aggravating, the defendant's actions do not support the government's program in eradicating corruption. The defendant's actions resulted in state financial losses in this case PT Pelindo II, the defendant was complicated in providing information," said prosecutor Wawan.
Meanwhile, the mitigating factor is that RJ Lino is considered polite and has never been punished.
In his actions, the Public Prosecutor of the KPK stated that RJ Lino was proven to have abused the authority and opportunity in his position by intervening in the procurement and maintenance of 3 QCCs, causing a total loss of state finances worth 1,997,740,23 US dollars.
RJ Lino's actions were carried out together with Ferialdy Norlan who served as Director of Operations and Engineering of PT Pelindo II and Weng Yaogen as Chairman of Wuxi Hua Dong Heavy Machinery Science and Technology Group Co. Ltd. (HDHM) China thus enriching HDHM China amounting to 1,997,740,23 US dollars.
PT Pelindo II is known to need a "container crane" and after several auctions it failed but failed so that in April 2009, PT Pelindo II again procured a "container crane" and changed the specifications of the used "crane" to "New Single Lift QCC" or " The new QCC Single Lift has a capacity of 40 tons through an auction mechanism for the Palembang port, Panjang port and Pontianak port.
After the auction was conducted, none of the participants met the requirements so that the auction failed so that PT. Pelindo II conducted a re-tender and also directly appointed PT Barata Indonesia.
RJ Lino then ordered Ferialdy Noerlan as Director of Operations and Engineering of PT Pelindo II to accompany representatives of Dong Heavy Machinery Science and Technology Group Co. Ltd. (HDHM) which is a company that manufactures "cranes" to conduct surveys.
The contract was signed on March 30, 2010 with a value of 17,165,386 US dollars for 11 months of 1 year warranty and for 5 years of maintenance for 1,611,386 US dollars.
Although the procurement and maintenance were carried out not following procedures, Pelindo II still paid HDHM of 15,165,150 US dollars for procurement and maintenance of 1,142,842.61 US dollars which resulted in state financial losses of 1,997,740,23 US dollars.
