Balaraja Police Chief Leads Justie's Restorative Process
JAKARTA - The case of employees who were arrested and detained because of a debt of Rp. 20 million to their superiors finally ended in peace. DS is released from custody.
Balaraja Police Chief Gede Prasetia Adi mediates and directs the restorative justice process in handling cases between DS—suspect status, reported by PT DIM.
Previously, DS was detained by the Balaraja Police for a report made by PT DIM because of the issue of a loan of Rp. 20 million. This money was borrowed by DS to his boss at the time, RDS on May 30, 2021.
The steps of the Balaraja Police Chief are appreciated. DS lawyer, Jatendra Hutabarat said the decision of the Balaraja Police Chief was in accordance with the Chief of Police Circular No. 8 of 2018.
According to Jatendra, SE Chief of the National Police is the basis for the police to prioritize restorative justice.
The police will follow up on this case by summoning the complainant. In the meeting it was agreed to resolve the problem peacefully.
"The family and legal counsel highly appreciate the steps taken by the Balaraja Police Chief and thank the reporting parties who are heartened to resolve this issue by withdrawing the report," said Jatendra to reporters, Tuesday, November 2 night.
By prioritizing the principle of restorative justice, the Balaraja Police hopes that the parties make peace and resolve problems with kinship.
The reason is that not all cases must be reported to the police and continue until the prosecution and trial if the parties decide to settle by agreement.
"The Balaraja Police brought together DS's family and PT DIM and an agreement was reached to withdraw this report, and DS was released from detention today," said Jatendra.
Restorative justice efforts in the police are not new. SE Kapolri Number 8/2018 is the basis for the police to prioritize restorative justice.
Moreover, the development of systems and methods of law enforcement in Indonesia shows a tendency to follow the development of community justice, especially the development of the principle of restorative justice which reflects justice as a form of balance in human life, said Jatendra.
