Former HST Regent Sentenced To 6 Years In Prison Plus Replacement Money Of IDR 30 Billion

The panel of judges chaired by Jamser Simanjuntak sentenced former Regent of Hulu Sungai Tengah (HST) Abdul Latif to six years in prison in a corruption case in the form of gratification and money laundering (TPPU) which was held at the Banjarmasin Corruption Court, South Kalimantan.

"The defendant was also fined Rp. 300 million with the condition that if he was not paid, he would be replaced with six months in prison," said Jamser when reading the verdict quoted by ANTARA, Wednesday, October 11.

The judge also sentenced the defendant to pay compensation of Rp30,939,266,006 provided that if it was not paid for one month after the court's decision with permanent legal force, the prosecutor's property was confiscated to be auctioned off to cover the replacement money.

However, if the defendant does not have sufficient assets, he will be sentenced to six years in prison.

The judge stated that the indictment of the public prosecutor (JPU) was all proven in the form of Article 12 B in conjunction with Article 18 of the Corruption Eradication Law in conjunction with Article 64 paragraph (1) of the Criminal Code as stated in the first indictment.

Then Article 3 of Law Number 8 of 2010 concerning Prevention and Eradication of Money Laundering in conjunction with Article 65 paragraph (1) of the Criminal Code as stated in the second indictment.

On this decision, the defendant who attended the online trial from Sukamiskin Prison, West Java, appealed.

Meanwhile, the Corruption Eradication Commission (KPK) team stated that they were thinking about it.

Abdul Latif was entangled by TPPU in the period 2016-2017 while serving as Regent of HST for the period 2016 to 2021.

Previously in the initial bribery case, he was sentenced to six years in prison and a fine of Rp. 300 million, subsidiary to three months in prison, and his political rights were revoked for three years because he was proven to have received bribes of Rp. 3.6 billion related to the construction of a treatment room at Damahuri Barabai Hospital.

The sentence was increased at the appeal level by the DKI Jakarta High Court, which was sentenced to seven years in prison and a fine of Rp. 300, subsidiary to three months in prison.

At the cassation level, Abdul Latif's sentence was added by the obligation to pay compensation of Rp1.8 billion, while the prison sentence, fines, and revocation of political rights remained at the level of appeal.
