Lukas Enembe Enters RSPAD, Corruption Court Judge Postpones Sentence Trial

JAKARTA - The Panel of Judges at the Corruption Court (Tipikor) at the Central Jakarta District Court (PN) postponed the trial of the verdict or verdict against the inactive Papuan Governor Lukas Enembe in the case of alleged bribery and gratification.

"Today's trial cannot be continued for the reading of the verdict and the panel of judges only read out the decision for the defendant while waiting for a report from the KPK public prosecutor for the next trial, while looking at the defendant's health development," said Chief Judge Rianto Adam Pontoh during a trial at the Corruption Court, Central Jakarta District Court. reported by ANTARA, Monday, October 9.

The panel canceled reading out the verdict which was due to be carried out today, after considering a letter from the Public Prosecutor (JPU) of the Corruption Eradication Commission (KPK) regarding the request for detention on the grounds of Lukas Enembe's health.

The Assembly also linked the application letter with the results of clinical laboratory examinations and the results of radiology at the Gatot Subroto Army Central Hospital (RSPAD) regarding the defendant's health condition.

According to the panel, the request for dismissal is quite reasonable to be granted. Therefore, the panel determined that the detention of the defendant must be delivered starting on October 6, 2023.

"Stipulate, grant the request from the public prosecutor at the KPK," said Pontoh.

The panel also ordered the KPK prosecutor to report the health development of the defendant Lukas Enembe for the purposes of determining the next trial.

"If indeed he has been declared able to participate in the trial again, later we will schedule the next trial officially. We are coordinating with each other between the KPK public prosecutor and the defendant's legal adviser," said Pontoh.

Lukas Enembe was absent from the trial because he was being treated at the Gatot Subroto Army Hospital for falling in the bathroom of the KPK detention center, Friday (6/10). Previously, Lukas' legal adviser had confirmed this.

"I make sure that Mr. Lukas cannot attend to hear the reading of the verdict because when he said goodbye he looked without expression," said Petrus Bala Pattyona, Lukas Enembe's legal adviser, in his statement, Sunday (8/10).

Petrus explained that while visiting his client on the 3rd floor of the RSPAD Stroke Unit with his teammates, Antonius Eko Nugroho, Sunday, Lukas Enembe's condition was still under medical treatment.

"I see that Mr. Lukas is being infused and fitted with a heart rate monitor. Mr. Lukas is weak. According to his family, since being treated on Friday (7/10) afternoon, Mr. Lukas often vomits that he has difficulty drinking or eating," he said.

The complaint about the illness, he said, had been felt by his client since Tuesday (3/10), such as headaches or dizziness. The legal advisor then asked the KPK doctor to treat his client.

Furthermore, the KPK doctor issued a recommendation letter to be referred to the RSPAD. However, he continued, Lukas Enembe was not directly referred to the RSPAD so that the incident occurred in the bathroom of the KPK Detention Center on Friday (6/10).

Prosecutors at the KPK stated that they would remain on charges and asked the panel of judges at the Jakarta Corruption Court to sentence Lukas Enembe to 10 years and 6 months in prison, as well as a fine of Rp. 1 billion, subsidiary to imprisonment for 6 months.

In addition, the claim to pay compensation in the amount of Rp47,833,485,350.00 was also sent to Lukas. With the provisions, in the event that Lukas does not have sufficient assets to pay the replacement money, he will be sentenced to imprisonment for 3 years.

In this case, the KPK prosecutor charged Lukas Enembe with two charges.

First, Lukas was charged with accepting bribes of Rp45,843,485,350 with details of Rp10,413,929,500 from Piton Enumbi businessman as Director and owner of PT Melonesia Mulia, PT Lingge-Lingge, PT Astrad Jaya and PT Melonesia Cahaya Timur, and Rp35,429,555,850 from Rijatono Lakka as Director of PT Tabi Anugerah Pharmindo, PT Tabi Bangun Papua as well as CV Walibhu.

Second, Lukas Enembe was charged with receiving gratuities in the form of Rp1 billion from Budy Sultan as Director of PT Indo Papua on April 12, 2013.
