Director Of KAI Subsidiaries Charged With Bribery Of Ministry Of Transportation Officials Rp1,125 Billion

JAKARTA - President Director of PT KA Properti Manajemen (KAPM) for the period July 2020 - January 2023 Yoseph Ibrahim and "Vice President" PT KAPM Parjono were charged with bribing two officials at the Directorate General of Railways of the Ministry of Transportation amounting to Rp1.125 billion related to the Java-Sumatra crossing work for the 2022 fiscal year.

"Defendant I Yoseph Ibrahim as the President Director of PT KAPM and defendant II Parjono as Vice President (VP) of PT KAPM gave money in stages totaling Rp1,125 billion to Harno Trimadi as Director of Infrastructure of the Directorate General of Railways of the Ministry of Transportation as well as Budget User Authority (KPA) and Fadliansyah as Commitment Making Officer (PPK) 4 at the Directorate of Railway Infrastructure of the Ministry of Transportation," said KPK (JPU) public prosecutor Andi Ginanjar at the Jakarta Corruption Court (Tipikor) reported by ANTARA, Monday, July 3.

The goal is for Harno Trimadi and Fadliansyah to arrange a cross section work package for Java Sumatra for Fiscal Year 2022 at the Directorate of Railway Infrastructure of the Ministry of Transportation to be won by PT KAPM.

PT KAPM is a subsidiary of PT. Kereta Api Indonesia (KAI) (Persero) with business activities in the property and construction sectors, which are specifically related to railways.

Yoseph Ibrahim became the president director while projects at PT. KAPM became the scope of Operations Director Afif Rusmiyadi who oversees 4 VP including VP of Roads, Rel and Bridges held by Parjono.

In 2021, PT KAPM will get a job to deal with natural disasters, namely flooding in the weak brother of the Directorate of Railway Infrastructure of the Director General of Railways of the Ministry of Transportation.

However, the work in its implementation uses the PT KAPM budget first and after the work is completed the realization of the budget is IDR 5.2 billion.

Parjono then asked the Directorate of Railway Infrastructure of the Ministry of Transportation for the work of handling natural disasters, but until the end of 2021, the Directorate of Railway Infrastructure of the Ministry of Transportation did not pay it.

In early 2022, Yoseph Ibrahim, Parjono and Finance Director of PT KAPM Riki Jayaprawira Subarna met with the Director of Railway Infrastructure of the Ministry of Transportation Harno Trimadi to ask for payment. Harno then informed that in 2022 there would be a project to repair the cross section of the Java and Sumatra areas, which would later be given to PT KAPM.

Harno then directed the two defendants to coordinate with the PPK project.

Harno asked Fadliansyah to win PT KAPM at the Java and Sumatra FY 2022 Regional Crossing work worth IDR 20 billion.

Fadliansyah asked his staff to assist PT KAPM in preparing technical specifications documents to meet the procurement requirements. Parjono also asked for adjustments to the procurement documents that could not be met in order to be adjusted to the specifications of the equipment belonging to PT KAPM.

In addition, Fadliansyah also directed Pokja to make special terms for the auction, namely related to the concrete specifications that must be from Wika Beton because PT KAPM has received support from PT Wika Sarana.

As a result of the auction, PT KAPM won the work contract "Coordination of the Java and Sumatra Regions" with a contract value of Rp20,752,776,802.

During the signing of the April 2022 contract, Parjono met Fadliansyah and asked how "fee" PT KAPM had to pay for the tender. Fadliansyah said the "commitment fee" was 5 percent of the contract value.

Parjono then conveyed to Yoseph Ibrahim that the way to fulfill the "fee" is to use the margin between the prices listed in the Budget Plan (RAB) and the prices obtained from the field according to reality and Parjono agreed.

In May - December 2022, Parjono with the approval of Yoseph Ibrahim to realize a total "fee" of IDR 1 billion to Harno Trimadi and Fadliansyah in stages 6 times in cash through the staff of the DJKA Infrastructure Directorate named Muhammad Ilman alias Idrus and directly to Fadliansyah.

"After the submission of the 'commitment fee', Defendant II Parjono reported it to Defendant I Yoseph Ibrahim," added the prosecutor.

In addition to giving the "fee" of Rp. 1 billion, Parjono with the approval of Yoseph also gave Rp. 125 million, with details of Rp. 25 million given to Fadliansyah for payment of hotel accommodation money in the context of audit of the Inspectorate General (Itjen) of the Ministry of Transportation in March 2023 and Rp. 100 million to Fadliansyah to be distributed to honorary employees, cleaning staff, security of the Directorate of Infrastructure as Holiday Allowances (THR) but canceled to be distributed by Fadliansyah because he was caught red-handed by the KPK on April 11, 2023.

In addition to giving to Harno Trimadi and Fadliansyag, Parjono with the approval of Yoseph Ibrahim also gave a total of Rp. 240 million, with details to Hamdan in the amount of Rp. 40 million; to the Chairperson of the Working Procurement Working Working Group 6 - Crossing Sebagai Wilayah Jawa and Sumatra FY 2022 Edi Purnomo in the amount of Rp. 100 million; and to the Chairman of the Working Group for the Procurement of Regional Crossing at the Railways in the Java and Sumatra Regions of FY 2023 Budi Prasetyo amounting to Rp. 100 million.

The defendants were charged with Article 5 paragraph (1) letter a or letter b or Article 13 of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code.
