JAKARTA - Coordinating Minister for Political, Legal and Security Affairs Mahfud MD has clarified directly to the ranks of the Constitutional Court regarding the issue of alleged leakage of information on the decision of the lawsuit against Law Number 7 of 2017 concerning General Elections.
"There have been rumors circulating outside that there have been decisions and so on. I made sure to the Constitutional Court, has it really been decided? Not yet," said Mahfud while giving directions at the 2024 National Election Coordination Meeting with the TNI Commander Admiral Yudo Margono and National Police Chief General Listyo Sigit Prabowo in Jakarta, Antara, Monday, May 29.
Mahfud added that the ranks of the Constitutional Court assessed that the issues circulating outside were only the result of the analysis of outsiders on the consideration of the attitude of constitutional judges.
The former chairman of the 2008-2013 Constitutional Court emphasized that the Constitutional Court would only hold a trial for the case, Wednesday, May 31, behind closed doors.
"So, there has been no official decision. It has been decided by six to three, or five to four, and so on; it does not exist yet," he said.
Mahfud invites the entire community to jointly look forward to and observe carefully the decision of the lawsuit against the open proportional election system regulated in the Election Law.
The case for the judicial review of Article 168 paragraph (2) of the Election Law was recorded with registration number 114/PUU-XX/2022 and received by the Constitutional Court on November 14, 2022.
The case was filed by six applicants, namely Demas Brian Wicaksono (Pemohon I), Yuwono Pintadi (Pemohon II), Fahrurrozi (Pemohon III), Ibnu Rachman Jaya (Permohon IV), Riyanto (Pemohon V), and Nono Marijono (Pemohon VI).
Eight of the nine political party factions in the DPR RI have stated that they reject the closed proportional electoral system, namely the Golkar, Gerindra, Democrat, NasDem, PAN, PKB, PPP, and PKS factions; while the PDI-P faction is the only one who wants the implementation of the system.
On Sunday, May 28, former deputy minister of law and human rights Denny Indrayana admitted that he had received information about the Constitutional Court's decision regarding the lawsuit in the case. Denny said the Constitutional Court would re-determine the implementation of a closed proportional electoral system.
"This morning, I received important information. The Constitutional Court will decide on the legislative election to return to a closed proportional system, again choosing the party's image mark," Denny said in a Twitter social media account upload @dennyindrayana, Sunday.
Denny admitted that he got the information from someone he trusted his credibility, but not a constitutional judge.
"Who is the source? The person I really trust is credibility, who is definitely not a constitutional judge," said Denny Indrayana.
