The West Sumbawa District Attorney, West Nusa Tenggara executed the detention of a convicted animal quarantine case named M. Habib Jamhuri at the Class IIA Sumbawa Besar Correctional Institution (Lapas). Head of the Intelligence Section of the West Sumbawa District Attorney's Office, Herris Priyadi, said that the execution of this detention was a follow-up to the arrest of Habib Jamhuri by the NTB Prosecutor's Arrest Team (Tabur), last Thursday. "As of today, the person concerned is on behalf of M. Habib Jamhuri undergoing detention at the Class IIA Sumbawa Besar Prison," said Herris when contacted, Antara, Friday, May 12. The convict is undergoing detention in accordance with the decision of the West Nusa Tenggara High Court number: 70/PID.SUS/2021/PT MTR, dated August 12, 2021, which upheld the decision of the first instance court. In the first instance court decision at the Sumbawa Besar District Court with number: 114/Pid.Sus/2021/PN Sbw dated June 17, 2021, Habib Jamhuri was sentenced to 3 months in prison and a fine of Rp. 2 million. The actions of the convict who sent 20 cows outside Sumbawa Island without pocketing certification from the quarantine center were found guilty in accordance with Article 88 letter a and c in conjunction with Article 35 paragraph (1) letters a and c of the Republic of Indonesia Law Number 21 of 2019 concerning Animal, Fish and Plant Quarantine jo. Article 55 paragraph (1) 1st of the Criminal Code. Furthermore, Herris said that the convict had paid a fine of Rp. 2 million. Therefore, Herris assured that the convict is currently only serving a criminal sentence. "So, the convict has paid a fine of Rp. 2 million. Therefore, the detention that the convict is currently only sentenced to probation for 3 months," he said. Meanwhile, Spokesperson for the NTB Prosecutor's Office, Efrien Saputera, said that the sowing team arrested the convict Habib Jamhuri based on the prosecutor's wanted list. "Habib Jamhuri was arrested by the NTB Prosecutor's Office Tabur Team on Thursday (11/5) afternoon in Mekar Damai Village, Central Lombok Regency. We arrested the person concerned in an inland area house," said Efrien. After the arrest, the NTB Prosecutor's Office Tabur Team, which is under the control of Section E of the Intelligence Division of the NTB Attorney General's Office, Denny Iswanto, immediately contacted the executor prosecutor at the West Sumbawa Kejari. "Because the location of the incident was on Sumbawa Island. Thursday (11/5) night, we handed over the convict to the executing prosecutor at the West Sumbawa Kejari. Our handover was carried out at Kayangan Port, East Lombok Regency," he said.
