PTUN Decision, Anies Must Return The Island Reclamation Permit. F

JAKARTA - The Jakarta State Administrative Court (PTUN) approved PT Agung Dinamika Perkasa's lawsuit against the decision of DKI Jakarta Governor Anies Baswedan. This means that the Decree (SK) regarding the revocation of the reclamation permit on F Island is canceled.

Judging from the Jakarta PTUN Case Tracking Information System, the lawsuit is registered with case number 153 / G / 2019 / PTUN.JKT. The decision was read out by the PTUN panel of judges on Tuesday, January 21.

"Declaring the State Administration Decree issued by the Governor of the Special Capital Region of Jakarta Province Number 1409 of 2018 dated 6 September 2018 concerning the Revocation of Several Governor Decrees concerning the Issuance of Special Reclamation Implementation Permits Against the Revocation of Decree of the Governor of DKI Jakarta Province Number 2268 of 2015 concerning Issuance of Implementation Permits Reclamation of Island F to PT Jakarta Propertindo, "said the verdict quoted by VOI.

The panel of judges also obliged Anies as the defendant to revoke the Governor's Decree 1409/2018. In addition, the Jakarta PTUN also sentenced Anies as a defendant to pay a court fee of Rp. 369,000.

"Require the Defendant to revoke the State Administration Decree issued by the Governor of the Special Capital Region of Jakarta Province Number 1409 of 2018," wrote the verdict.

This decision was read by Andi Muh Ali Rahman as chairman of the panel of judges and Umar Dani and Enrico Simanjuntak as members. This case trial has also been running since September 3, 2019.

Where PT Agung Dinamika Perkasa is suing for the revocation of the F Island reclamation permit with case number 153 / G / 2019 / PTUN.JKT. PT Agung Dinamika Perkasa registered the case with PTUN Jakarta on July 26, 2019.

Previously, the Governor's Decree Number 1409 of 2018 was made by Anies on September 6 2018, as a legal basis for canceling the reclamation permit in the Decree of the Governor of DKI Jakarta Province Number 2268 of 2015 made by the former Governor of DKI, namely Basuki Tjahaja Purnama or Ahok.

At that time, DKI Jakarta Governor Anies Baswedan emphasized that the lawsuit filed regarding F Island was filed by the developer, not the BUMD belonging to the DKI Provincial Government.

"That is the developer, not the BUMD that challenges (in court) the BUMD does not. If the BUMD challenges, it is removed immediately," said Anies, Wednesday, August 7, 2019.
