Prosecutor Demands AKBP Achiruddin Hasibuan 6 Years In Prison In Illegal Solar Case
The North Sumatra High Prosecutor's Office (JPU) has charged AKBP Achiruddin Hasibuan with imprisonment for six years in an illegal diesel case.
"Asking the panel of judges who examine and try this case to sentence the defendant to six years in prison, a fine of Rp. 50 million, subsidiary to three months in prison," said Public Prosecutor Randi H Tambunan at the Medan District Court, North Sumatra, as reported by ANTARA, Monday, September 18.
The prosecutor assessed that the defendant Achiruddin Hasibuan violated Article 55 number 9 paragraph 5 of the fourth part of Chapter III of Law Number 2 of 2022 concerning Job Creation which has been stipulated into law in accordance with Law Number 6 of 2023 concerning Stipulation of Government Regulations in lieu of Law No. 2 of 2022 concerning Job Creation into Law in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.
The thing that burdens the defendant's actions, said the prosecutor, is that the defendant's actions are troubling the community, his actions are contrary to the government's program in distributing subsidized diesel fuel and the defendant is a police officer who should protect the community, while there are no mitigating factors.
Meanwhile, partners with Edy as Director of PT Almira Nusa Raya (separate files) and Parlin as an employee were sentenced to four years in prison, a fine of Rp. 50 million, subsidiary to three months in prison.
"The aggravating thing for the two defendants contradicts the government's program in distributing subsidized diesel fuel, while the mitigating factors between the two defendants are polite," said Randi.
After reading the memorandum of demand by the North Sumatra Prosecutor's Office, the panel of judges chaired by Oloan Silalahi continued the trial with a memorandum of defense (pledoi) scheduled for next week.
In the indictment, it was presented in April 2022, when the defendant met Kasim to look for a box car for a business with an agreement at a price of Rp. 38 million. After getting the car, the defendant modified it by adding two 1,000-liter battery tanks.
Furthermore, the defendant ordered Jupang as a driver to transport condens/sulawesi oil located at Pangkalan Berandan to be resold to buyers at a higher price.
Then the van was used as a means of transporting diesel fuel in the areas of Medan, Deli Serdang and Binjai.
The fuel was purchased at gas stations at a price of Rp. 6,800 to be taken to a storage warehouse owned by PT Almira Nusa Raya. But the purchase is suspicious because it buys close time and day.

After that, the diesel fuel was stored in a warehouse with a tank loaded with 16 tons. When the diesel was scarce, the defendant sold it to factory consumers with a profit of IDR 300 above the government price.
Furthermore, North Sumatra Police investigators took action and found the diesel warehouse and found items such as fiber tanks, diesel pumps, and tanks containing diesel oil on Jalan Guru Sinumba, Medan Helvetia, Medan.
