2 Makassar PDAM Corruption Defendants Sentenced To 30 Months In Prison
The Panel of Judges for Corruption has finally sentenced two defendants in the alleged corruption case of PDAM Makassar, respectively Haris Yasin Limpo (HYL) and Irwan Abadi (IA) to a criminal sentence of two years and six months or 30 months in prison.
"The defendant was legally and convincingly proven to have committed a criminal act of corruption together and continued. Sentencing him to prison for two years and six months and a fine of Rp. 200 million," said Chief Justice Hendrik Tobing in the main courtroom of Harifin A Tumpa, Makassar Class IA District Court, South Sulawesi, as reported by ANTARA, Tuesday, September 5.
For this decision, the two defendants and the Public Prosecutor of the South Sulawesi High Prosecutor's Office were given the opportunity to think, appeal or accept a decision no later than 14 working days after the verdict was read.
The Public Prosecutor (JPU) of the South Sulawesi High Prosecutor's Office Muhammad Yusuf at the previous trial had read out the demands to the two defendants, namely former President Director of PDAM Makassar Haris Yasin Limpo and Director of Finance PDAM Makassar Irawan Abadi.
The defendant in charge of violating Article 2 paragraph (1) in conjunction with Article 18 of Law No. 31 of 1999 concerning Eradication of Corruption in conjunction with Law of the Republic of Indonesia number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia number 31 of 1999, in conjunction with Article 55 paragraph (1) 1st of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code in the primary indictment.
However, the decision was lower than the prosecutor's demands, namely demanding that the two defendants be sentenced to 11 years in prison and a fine of Rp. 500 million, subsidiary to 6 months in prison and paying compensation to the state of more than Rp. 12.4 billion.
In addition, if the replacement money is not paid within a maximum of one month after the court's decision has permanent legal force (inkrah), the defendant's property will be confiscated by the prosecutor to be auctioned to cover the payment of the replacement money.
"And if the defendant does not have sufficient property, he will be replaced with imprisonment for five years and six months," he said.

As a result of the actions of the two defendants during the 2017-2019 term of office, the total state financial loss of Rp20.3 billion was more in accordance with the Audit Results Report on the Calculation of Losses on State Finances or BPKP.
Allegations of PDAM corruption are related to payments for Tantiem and Bonus/Source Production since 2017-2019 and Premium Asuransi Dwiguna as Mayor and Deputy Mayor of Makassar from 2016-2019.
