Suffering From Residents Of Kampung Bayam, Tanjung Priok Who Displaced The Jakarta International Stadium Project

JAKARTA Residents of Kampung Bayam, Tanjung Priok, North Jakarta who were affected by the construction of the Jakarta International Stadium (JIS) have the right to stay in Kampung Susun Bayam. This, according to a resident named Shirley Aplonia, refers to the North Jakarta Mayor's Letter number e-0176/PU.04.00 and the previous draw of the block in Kampung Susun Bayam.

However, the reality is, there are still 75 families or around 200 people who have not been able to use their rights. This is because PT Jakarta Propertindo (Jakpro) as the manager of Kampung Susun Bayam has set an unaffordable monthly rental rate.

"How can residents pay rent of 715 thousand per month, after all, their work is mostly only scavengers or buskers. How much is the daily income from mulung and ngmen? Getting 50 thousand one day is already the top, can he go home, "said Shirley, a member of the Bayam Village Brotherhood (PWKB) to VOI on February 20, 2023.

As a result, they live adrift. In fact, five families of whom have to camp in front of Kampung Susun Bayam, because they no longer have money to rent or find other places to live.

Shirley wonders why the DKI Provincial Government actually seems to allow Jakpro's imposition of high tariffs, not managing its own Kampung Susun Bayam. This clearly violates Kepgub 878/2018, Kepgub 979/2022, and Pergub 90/2018, which are the basis for the implementation of village arrangement.

The Governor of DKI Jakarta as the giver of the mandate has the main responsibility to ensure that the village arrangement mechanism is carried out properly, and is able to fulfill the right to proper housing.

"Kampung Akuarium and Kampung Cikunir can only set low tariffs for residents of evicted victims, why can't Kampung Susun Bayam," said Shirley.

The rental price in Kampung Akuarium, according to him, is only IDR 33,800 per month, but it must be paid within a certain period of time, for example.

"We are still able to do this. We can still try from what we have, want to go through cooperative funds or what. Now, they want to comply with Governor Regulation 55, the general tariff is also heavy. The point is, we are victims of JIS installments, not the people who can afford it, "said Shirley.

The Coordinator of Urban Poor Consortium, Gugun Muhammad, also assessed that the rental retribution rate for the residents of Kampung Bayam should not use the DKI Governor Regulation scheme Number 55 of 2018, but instead use the precedent that has been applied in Kampung Susun Aquarium and Kampung Susun Cikunir.

This is because the context of the construction of flat villages is as compensation for residents affected by development projects from the DKI Provincial Government. As well as ways to fulfill residents' rights to good housing.

"Why can the Aquarium Susun Village and Cikunir Flats be cheaper? Because it is managed by cooperatives," Gugun said as confirmed by VOI on February 20, 2023.

The cooperative initially paid rent to the DKI Provincial Government for 5 years with an amount of Rp. 34,000-Rp. 40,000 per unit. Very affordable for residents.

PWKB has tried to find common ground to discuss rental rates, either through meetings with Jakpro or the DKI Provincial Government. However, according to Shirley, there was never room for residents to discuss. On December 1, 2022, residents decided to hold an action at the City Hall of DKI.

Several representatives of residents were invited to go inside but no Provincial Government wanted to meet representatives from Kampung Bayam. The next day, we came back and met with Kesbangpol. However, there is still no realization whatsoever," he said.

PWKB considers the actions of the DKI Provincial Government and Jakpro to violate the general principles of good governance, such as the principle of legal certainty, openness, and public interest.

In the principle of legal certainty, the DKI Provincial Government and Jakpro can grant ownership and management rights directly to residents, as promised and confirmed directly by the DKI Provincial Government and Jakpro and reaffirmed by the North Jakarta Mayor's Letter number e-0176/PU.04.00 which has verified the names of the prospective residents and the Kampung Susun Bayam unit number.

In the principle of openness, during this process, according to Shirley, residents did not get information openly honestly, transparently, and accountably.

"Seharusnya, dalam setiap pertemuan khususnya dalam pembahasan biaya sewa, perlu adanya diskusi dengan warga Kampung Bayam. Bukan bersifat sosialisasi, melaitkan keberebangan dalam berdialog/diskusi, tulis PWKB dalam siaran resmi pada 20 Februari 2023.

Responding to this, PWKB accompanied by the Jakarta Legal Aid Institute raised administrative objections to the Acting Governor of DKI Jakarta and asked the DKI Provincial Government and Jakpro to:

"We, residents of PWKB, especially hope to enter soon. Price negotiations can be carried out after we occupy Kampung Susun Bayam," said Shirley.

Vice President Corporate Secretary of PT Jakarta Propertindo (Jakpro) Syachrial Syarif said that former Bayam Village residents have not been able to inhabit the flats due to legality matters. Legalization is needed to clarify Jakpro's rights and obligations in managing Kampung Susun Bayam.

This is because the ownership of land and buildings of Kampung Susun Bayam is different. The current land status of Kampung Susun Bayam belongs to the DKI Jakarta Youth and Sports Agency (Dispora). Meanwhile, the flat building was founded by Jakpro.

"So what is clear is that we are still discussing with the Office in the Provincial Government to provide legality to us to rent out," Syachrial told reporters on February 20, 2023.
