Mastur Sued 5.5 Years In Prison For Village Fund Corruption

JAKARTA - Public Prosecutors from the Mataram District Prosecutor's Office, West Nusa Tenggara sue Mastur, the defendant in the Kuripan Village Fund / Village Fund Allocation (DD / ADD) corruption case in 2015-2016 for 5.5 years in prison.

"With this we believe that the defendant has been proven guilty of corruption in the management of DD / ADD in 2015-2016, causing considerable state losses," said Attorney Muthmainah at the Mataram Corruption Court, reported by Antara, Thursday, November 12.

The defendant's mode of committing the criminal act of corruption occurred when he was the Head of Kuripan Village. The prosecutor saw that there were attempts to manipulate data in the accountability report for the use of the budget.

In addition to imprisonment charges, the prosecutor also asked the panel of judges to impose a fine of Rp. 200 million in addition to six months in prison.

The defendant was also required to pay compensation for state losses amounting to Rp. 338.93 million from the amount that appeared to be worth Rp. 677.87 million. This value is the result of a reduction in state losses, part of which has been borne by the secretary of the activity implementation team, Johari Maknun.

If the defendant is unable to pay within the stipulated time limit, then his legal obligation is to replace his assets.

"However, if the assets have not been sufficient to replace it, then the defendant must replace it with one year of body confinement and six months in prison," he said.

In the description of his demands, Johari Maknun is suspected of being involved with Mastur to take personal benefits from the management of DD / ADD in 2015-2016.

The prosecutor stated that Johari and Mastur made duplicate stamps to finalize their accountability report.

"So this expenditure was made as if it were in accordance with the RAB," said the prosecutor who is familiarly called Iin.

In the item of his accountability report, the prosecutor believed that Mastur was proven to be corrupt in the construction of village physical projects, which, among others, were related to the construction of rebates, taluds, bridges and gabions. This physical project also found a lack of work volume.

Then there are also those related to the project to procure futsal goals, meatball milling equipment, three-wheeled motorbikes for village ambulances, trash bins, computer equipment, and lawn mower procurement. The procurement of the goods was deemed not in accordance with what was reported.

There is even a money loan from the village treasury which totals Rp. 48.54 million. Mastur, who at that time was a policy maker in the village, had the status of a borrower and only returned Rp10 million.

Iin said that some of the money had been used for personal gain, and also for THR money for BPD officials, TPK, and village officials.

Therefore, the prosecution stated the charges against the defendant in accordance with the indictment of Article 2 Paragraph 1 Juncto Article 18 of the Corruption Act in conjunction with Article 55 Paragraph 1 of the Criminal Code and Article 64 of the Criminal Code.

The prosecutor also viewed the prosecution's consideration of the good faith efforts of the defendant in recovering state losses. Until now, Iin said the state losses had not been replaced.

Meanwhile, Mastur's legal adviser, Izrail, said he was surprised by the prosecutor's demands. he thought the demands were too much. However, his party will remain professional, defense efforts will be presented at the next trial.

"We will try it through a defense note. We will convey it at the next trial," Izrail said.

Kuripan Village manages DD / ADD and Regional Tax and Retribution Revenue Sharing (BHPRD) amounting to IDR869.78 million in 2015. Then IDR1.3 billion in 2016.
